Pop Punch Terms of Use

These terms set out the conditions for using the Pop Punch app (the “App”) provided by Fastutle (“we” or “us”). By downloading or using the App you agree to these terms. The terms of the store you downloaded the App from (App Store, Google Play) also apply.

1. The service

1. The App is a casual speed-tap game in which you tap a character as fast as you can for a score. It offers Free Mode with no limits, Challenge Mode in which you use challenge tickets to go for a record, photo characters made from your own photos, editable speech-bubble lines, leaderboards and achievements, and sharing results and challenges with friends.
2. You can use the App without signing up. We do not run any server that receives or stores your photos or game records.
3. The features available to you may differ by device, operating system (iOS, Android) and app version.

2. Use of the App and prohibited conduct

1. We grant you a non-exclusive, non-transferable right to use the App for your personal use in accordance with these terms.
2. You must not:
   • use the App in a way that violates the law;
   • obtain or manipulate scores, challenge tickets, achievements or leaderboard entries by unfair means, such as tampering with the App or its data on your device;
   • click ads fraudulently, or view or click ads by automated means;
   • make a photo character from another person’s photo without that person’s consent, or use photo characters and speech-bubble lines to insult or harass others;
   • reverse engineer, decompile or disassemble the App, except where the law allows it;
   • circumvent the App’s security features, or interfere with the normal operation of the App or the services it connects to;
   • copy or modify the App to distribute or sell it.
3. If your prohibited conduct causes damage to us or to others, you may be liable for it under the law.

3. Intellectual property

1. The rights in the App’s software, design, name, logo, default character artwork, sound effects and default speech-bubble lines belong to us or to their rightful owners. These terms give you the right to use the App; they do not transfer those rights to you.
2. Open-source components included in the App are governed by their own licences. The list is available on the open-source licences page of this site.

4. Your content

1. The photos you use for photo characters, the character names, and the speech-bubble lines you enter or edit are yours, and you are responsible for their contents and for how you use them.
2. Please use only photos of yourself or photos whose subjects have given their consent. You must have the rights needed for the photos you use.
3. Photos, character names and speech-bubble lines are processed only on your device and are not sent to us. We do not view or review them.
4. Whether to share a result image or a challenge with friends is up to you, and what you share is subject to the terms and policies of the place you share it.

5. Third-party services

1. The App uses the following third-party services, each governed by its provider’s terms and privacy policy.
   • Google AdMob and Google’s consent management tool (UMP): serving and measuring ads, and ad consent
   • Google Firebase (Analytics, Crashlytics, Remote Config): usage statistics, crash reports, and app settings such as the number of challenge tickets
   • Game Center (Apple, iOS) and Play Games (Google, Android): leaderboards and achievements (optional)
   • On-device face detection (Apple Vision on iOS, Google ML Kit on Android): finding the position of faces in photos
   • App Store, Google Play: distribution and updates of the App
2. We do not operate these third-party services. If a service changes or stops, the App features that rely on it may not work.
3. How the App handles information is described in the Privacy Policy.

6. Ads, Game Center and Play Games, and challenge tickets

1. Ads: The App shows Google AdMob ads. Products and services in ads are provided by the advertisers, and any dealings with them are between you and the advertiser. Users in the European Economic Area, the UK and Switzerland can change or withdraw their ad consent in the App under Settings > Ad Consent Settings. Please report inappropriate ads in the App under Settings > Report an Ad.
2. Game Center and Play Games (optional): On iOS, leaderboards, friend challenges and achievements use Apple’s Game Center; on Android, leaderboards and achievements use Google’s Play Games. When you sign in, the App sends only your scores and achievement progress to that service, and account information such as your nickname is handled under Apple’s or Google’s terms and policies. You can use every other feature of the App without signing in. We may remove records that appear to have been obtained by unfair means from the leaderboards, to the extent the service allows.
3. Challenge tickets: Challenge tickets are an in-app allowance of plays for Challenge Mode.
   • Challenge tickets have no cash value, cannot be exchanged for cash or anything else, cannot be transferred to anyone else, and are not refundable.
   • Challenge tickets refill at set times, and you can get extra tickets by watching rewarded ads. The standard number of tickets and when and how they refill are shown in the App, and we may change them through app updates or changes to app settings.
   • Your remaining tickets are stored only on your device, so they are lost and cannot be restored when you delete the App on Android or reset your device on iOS.

7. Disclaimer of warranties and limitation of liability

1. The App is provided as is. We do not warrant that the App will work without interruption or error on every device, that ads or leaderboards will always be available, or that it fits any particular purpose of yours.
2. We are not liable for the following damage, except damage caused by our intent or gross negligence:
   • damage caused by events beyond our control, such as natural disasters or network failures;
   • damage caused by problems with your device, its operating system or third-party services;
   • damage caused by your breach of these terms or by a failure to look after your device and data;
   • disputes between you and others over the photos or lines you use or the content you share.
3. This section does not limit the rights the applicable law guarantees you, and it does not apply to any liability of ours that the law does not allow us to exclude.

8. Changes and termination

1. We may add, change or remove features of the App through updates.
2. When we change these terms, we post the changes and their effective date on this page at least 7 days before they take effect, or at least 30 days before for changes that are unfavourable to you or otherwise significant. If you do not agree to the changed terms, you can stop using the App and delete it; if you keep using the App after the effective date, you are deemed to have agreed to the changed terms.
3. We may stop distributing or updating the App, and if we do, we will announce it on this site in advance where possible.
4. You can stop using the App at any time by deleting it.

9. Governing law and jurisdiction

1. These terms are governed by the laws of the Republic of Korea.
2. We will first try to resolve any dispute about the App amicably through the contact below. If legal action is needed, it is brought before the court that has jurisdiction under the Civil Procedure Act of the Republic of Korea.
3. If the consumer protection laws of the country where you live give you mandatory rights that are more favourable to you, this section does not exclude them.
